Lending or loaning your property to someone may help them out, but it can sure put you in a quandary, especially of the person you have lent/loaned it to is not a responsible individual.

Be it a car or a house; if there is damage, you need to ask for a settlement.

 

A demand letter to settle a property damage issue is written firmly.

There is no leeway to be given, as there is usually a substantial amount of money involved.

But you do not want to offend the perpetrator by being rude, so it is always a good idea to keep a formal tone.

Write what you want to but do not sound threatening. After all, you do not want him thinking that you are harassing him for money.

Letters of this sort while casual, can be used as evidence in a court of law. This is especially true if you end up being in a situation where the perpetrator attempts to counter you.

Dear Mr. Worth:

As a tenant, you vacated my property 667 Elms Place, Saint Clairsville, OH on May 30 following the end of our lease agreement. Since I was not in the city on the day you vacated, I could not check that you had indeed abided by the terms stated in the initial agreement particularly the one that mentioned ‘loss or damage to property.’

Upon my return, I found the house to be in a complete state of disrepair and total shambles – the home that I build with so much love and effort is now a shadow of its former self.

Here is a list of damages that I would like to bring to your notice:

  • First floor’s master bedroom window broken and rusted.
  • Paint chipped off, and strange ink markings are evident all over the house.
  • Kitchen sink and laundry area sinks are rusted and broken.
  • Three faucets (kitchen, upstairs bathroom and downstairs bathroom) are broken.
  • Front door wood is chipped, and paint is coming off.
  • All porch lights are damaged.
  • Five switchboards (3 in the living room and 2 in the upstairs hallway) are broken.

This is a significant amount of loss, which comes to $3901 – this amount has been carefully calculated by my appraiser and includes labor costs, so there is no room for bargaining here.

Please arrange to pay this amount within 10 days of receipt of this letter so that I can have the repairs sorted out.
